Can my employer keep my passport or alien registration card in Korea?
No. Korean immigration law prohibits anyone from taking a foreigner's passport or alien registration card (외국인등록증) as security for an employment contract or a debt, and it also prohibits forcing or arranging that. An employer who holds your documents "until the contract ends," "until you repay the airfare," or "so you do not run away" is doing exactly what the law forbids, and the penalty is criminal, not just a fine. You can ask for the documents back today and report if they are refused.
What exactly does the law prohibit?
The Immigration Act has a specific article about identity documents. It bans receiving a foreigner's passport or registration card as a means of securing a work contract or the performance of a debt, and it bans coercing or brokering such an arrangement. Three points follow from the wording:
- It applies to anyone, not only employers: a broker, a dormitory manager or a relative of the owner is covered.
- It covers the registration card as well as the passport. "We only kept your card" is not a defense.
- The reason given does not matter. Safekeeping, a loan, a training fee, or a damage deposit: if the document is held so that you will stay or pay, it is within the ban.
A person who violates this article faces up to 3 years in prison or a fine of up to 30 million won. When an employee of a company does it for the company's business, the company itself can be fined as well.
Can I be punished for handing it over?
The prohibited act is receiving the document as security or forcing someone to give it. A worker who handed over a passport because the employer demanded it is the person the rule protects, not the target. There is a separate duty in the same law for every foreigner to carry the passport or registration card at all times and to show it when an immigration officer asks. An employer who keeps your documents puts you in breach of that duty, which is one more reason to get them back quickly. If you are stopped without your card, explain who is holding it and where.
Is "voluntary" safekeeping different?
Sometimes an employer says the worker asked for the documents to be kept in the office safe. Genuine safekeeping that you can end any time, where the document is returned the moment you ask, is not the same as holding it as security. The test is practical: ask for it back. If the answer is "after you finish the season," "after you repay what you owe," or "we will think about it," the arrangement is security, whatever it was called at the start. Put the request in a text message so that the refusal is recorded.
What should I do first?
1. Ask in writing. Send a short message: "Please return my passport and alien registration card today. I need them." Keep the message and any reply. 2. Photograph what you have. If you have a photocopy or photo of the documents, save it. Note the date you handed them over and who took them. 3. Tell someone outside the workplace. A co-worker, your embassy, or a support center for foreign workers. A witness to the refusal helps later. 4. Do not sign a paper that says you gave the documents voluntarily or that you owe money in exchange for them.
Where do I report?

You can report to more than one. If the employer is also withholding wages or threatening to report you to immigration, start with the labor office and mention the documents there; the offices pass information to each other. For E-9 workers, holding documents is strong evidence of unfair treatment, which supports a workplace change that does not count against your limit.
Will reporting hurt my visa?
Reporting that your employer holds your passport does not by itself affect your status. If your registration card has expired or your stay has become irregular while the employer held the documents, say so when you report, with the dates; the delay was caused by the employer and that context matters. If you need to leave Korea and the passport is still being held, your embassy can issue a travel document, and the immigration office can be asked to require the return of the original.
